Representative Elder Law Matters handled by the Gemma Law Office, P.C.

Scenario A: Client comes to our Office seeking advice regarding planning strategies to preserve assets for their own care and that of their spouse, should one or both of them need long term nursing home care, at some point in the future. Assets often involve their home and savings accounts. Often, we help the Client with not only the legal advice, but with the filing of the Medicaid long term care application itself.

Scenario B: Same as the first scenario, except the timeline of events is different. Instead, the client is either in the nursing home already, or expects to need a nursing home in the immediate future. Friends or advisors have suggested that the client seek the advice of an elder law attorney. We help the Client review their options and decide upon a course of action that best reflects the Client's goals and priorities.

Scenario C: Family member contacts the Office and seeks advice regarding an older parent who faces issues with incapacity. Often, the parent faces the onset of dementia, Alzheimer's type or other degenerative diseases that affect their cognitive ability. If necessary, we help client to obtain legal authority to act on behalf of the incapacitated individual through the Court.

Scenario D: Client seeks an estate plan that protects against the need for a guardianship or conservatorship in case of disability, while addressing necessary tax planning, asset distribution, asset preservation, as well as continued and future protection of family beneficiaries. We put together an estate plan designed to avoid guardianship, if possible, while continuing the management of the client's personal and financial needs.
